Q: Waiver for wife

What are the chances a waiver is approved of the person left the country due to harassment over sexual orientation?

A: Response from Brian Esser

Hi, I'm a bit unclear about what you are asking. If you are asking about an asylum petition, people regularly receive asylum in the US if they are fleeing persecution based on sexual orientation. If you are asking about waivers of other types as she is applying for permanent residency based on your marriage, I would need more information.

In either event, you should consult an immigration lawyer who can advise you on the specifics of your circumstance. You can contact your local LGBT lawyers association or LGBT community center for a referral to a lawyer competent in working with same-sex couples.
